GENERAL TERMS AND CONDITIONS
PREAMBLE
The purpose of these general terms and conditions of sale is to define the terms and conditions of sale that apply exclusively between Simone Pérèle SA Benelux, Belgian Business Centre, Chaussee De Roodebeek 206, 1200 Brussels, Belgium, registered under number BE 0477.827.938 (hereinafter referred to as "Simone Pérèle Benelux" or the "Seller") and any non-trading individual (hereinafter referred to as the "Customer"), seeking or making a purchase via the website https://www. simone-pérèle.com/en-be/ (Belgian version) and the website https ://https://www (hereinafter referred to as the "Site"). simone-pérèle.com/en-be/ (Belgian version) and the site https ://www.simone-perle.com/nl-be/ (hereinafter the Site).
It is agreed that the Customer and the Seller will be collectively referred to as the "Parties" and individually as the "Party".The products offered for sale on the Site are corsetry products, night lingerie, swimwear and accessories of the Simone Pérèle brand, hereinafter referred to as the Products.
ARTICLE 1 - APPLICATION AND ENFORCEABILITY OF THE CGVS
Every order placed on the Site implies the prior consultation and acceptance of these General Terms and Conditions of Sale before the order is validated. Every order placed on the Site will be validated by the prior acceptance of the General Terms and Conditions of Sale in force on the day of the order by means of a checkbox "I have read and accept the General Terms and Conditions of Sale". The Seller reserves the right to modify the General Terms and Conditions of Sale from time to time and without prior notice. The Customer acknowledges that he/she has full legal capacity to enter into the present General Terms and Conditions of Sale.
ARTICLE 2 - SCOPE OF APPLICATION OF THE GVCS
The purpose of these general terms and conditions of sale is to define the rights and obligations of the Parties in connection with the online sale of Products on the Site. They apply to the exclusion of any other document. These conditions only apply to purchases made on the Site for delivery in Belgium and Luxembourg.
ARTICLE 3 - INFORMATION ON OFFERS AND PRODUCTS
The Vendor presents on the Site the Products for sale with the characteristics necessary to enable the Customer to know, before the final validation of his order, the essential characteristics of the Products he wishes to purchase, and this in accordance with article VI. 45 of the French Code of Economic Law.The Products are presented as accurately as possible. However, the Vendor cannot be held responsible for any slight discrepancies in the description or presentation of the Products (photographs, texts, illustrations, product colors, etc.).Offers are valid only in Belgium and Luxembourg, during the period in which the Products are online, and while stocks last.Errors or modifications may exceptionally occur in relation to the availability of a Product, particularly in the case of simultaneous orders of the same Product by several Customers.
In the event that one or more Products are unavailable after an order has been validated, the Customer will be informed by e-mail or telephone within 48 working hours (except during promotional periods and sales, when this period may be extended by a few days) of receipt of the order by the Vendor. The Customer will then have the choice of (i) confirming the remainder of the order for available Products, or (ii) cancelling the entire order. If the order contains only one product, the Vendor will inform the Customer of the Product's unavailability and the order will be cancelled.
ARTICLE 4 - PRICES
Price information
Product prices are quoted in euros, inclusive of all taxes (VAT), on the basis of the prices in force on the day of the order. Prices include VAT applicable on the date of the order, and any change in the applicable rate of VAT will be automatically reflected in the price of the products in the online store. Payment in full must be made at the time of ordering.
If one or more taxes or contributions, in particular environmental taxes, are created or modified, either upwards or downwards, this change may be reflected in the sale price of the products. Telecommunication costs, such as Internet costs, are the responsibility of the customer.
It is possible that obvious price errors occur on our Site during the validation of an order. The Vendor undertakes to inform each customer concerned as soon as possible. Should the sum paid for an order be less than the sum due (low price), the Vendor will be obliged to cancel the order. In the opposite case, the customer will be reimbursed as soon as the error has been noted.
Delivery costs
Delivery costs are free of charge for orders of €140 or more, including VAT, for Colissimo home delivery and delivery to a "point relais", and are never offered for delivery by TNT.
- Delivery to a Simone Pérèle boutique within 48h to 72h: free of charge, with no minimum purchase.
- Delivery to a "point retrait" within 48h to 72h: €4.90, free of charge for orders of €140 or more.
- Home delivery within 48 to 72 hours: €5.90, free for orders over €140.
- Home delivery within 24 hours: €11.00 (for orders placed Monday to Friday before 12:00, excluding public holidays)
Price changes
The Seller reserves the right to change prices at any time, but agrees to apply the current prices indicated at the time of order, subject to product availability at that time.
ARTICLE 5 - ONLINE ORDERING
The order process is as follows:
1. Access to the Site.
2. Creation of a Customer Account:
In order to place an order on the Site, all new customers must create a Customer Account and provide the personal information required to place the order and ensure delivery and invoicing of the Products. Once the Account has been created, an e-mail will be sent to the Customer confirming the login details. All information collected will remain strictly confidential. The Customer acknowledges and accepts that the use of his/her e-mail address and personal password constitutes authentication of the Customer. Any order placed using the login details will be deemed to have been placed by the account holder. Customers who already have a Customer Account simply need to identify themselves using their e-mail address and personal password before placing an order.
3. Item selection:
The Customer selects the Product(s) of his/her choice and, once he/she is ready to purchase them, adds them to the shopping cart by simply clicking on the "Add to cart" button.
4. Checking the order basket:
By clicking on the "View my basket" button, the Customer can check the number of Products contained in their basket, modify it, continue with their Product selection or validate their basket to move on to the next stage.
5. Order registration:
After validating the shopping basket and accessing the customer account, the customer proceeds with the order by choosing the delivery address, the delivery method with the corresponding price, the billing address and the payment method.
After viewing the order summary, once all the requested information has been completed by the customer, and before payment, the customer acknowledges the general terms and conditions of sale by checking the appropriate box.
6. Order validation
After reading the summary order form, the Customer clicks on "order and proceed to payment" to confirm his/her order.Validation of the order by clicking on "order and proceed to payment" constitutes an electronic signature.
However, the Vendor reserves the right to refuse an order from a buyer who has not paid in full or in part for a previous order, or with whom a dispute is in progress, or in the event of refusal to authorize payment by credit card by the banking authorities for the current order.
7. Acknowledgement of receipt of the order:
After acceptance of the order by the Vendor and validation of payment by the Customer, the Customer will receive an email at the address communicated in his/her customer account confirming the order and summarizing the obligatory information contained therein (in particular order number, Products, Price including shipping costs, delivery and billing address).
The Vendor will not be held responsible in the event of non-receipt of the order acknowledgement in the event of a data entry error or any other cause beyond the Vendor's control. The Vendor also invites the customer to check that this e-mail has not been placed in the spam section of his mailbox.
8. Unavailability of one or more products in the order
In the event that the order is made up of a single product and this product is unavailable, the Customer Service Department will contact the Customer by e-mail and/or telephone to inform him/her that the order has been cancelled and reimbursed automatically.In the event that the order is made up of several products, one of which is unavailable, the Customer Service Department will contact the Customer by e-mail and/or telephone to propose the total cancellation of the order or the dispatch of the other available products in the order.
ARTICLE 6 - CUSTOMER SERVICE

ARTICLE 7 - PAYMENT

ARTICLE 8 - RESERVATION OF OWNERSHIP
The Products ordered by the Customer will remain the exclusive property of Simone Pérèle BENELUX until full payment of the order by the Customer.
ARTICLE 9 - SHIPPING
Products are delivered in Belgium or Luxembourg to the delivery address specified by the Customer on the order form. Any error in the delivery address communicated by the Customer will be the full responsibility of the Customer, who must assume all consequences.
Any parcel returned to Simone Pérèle Benelux due to an erroneous or incomplete delivery address will be reshipped at the Customer's expense.
Products ordered are delivered from our warehouse located in France.
Orders placed on the Site on Fridays from 12pm, Saturdays or Sundays will not be processed until the following Monday.
Orders placed on the Site on a public holiday will be processed on the next working day. Orders placed on the Site on public holidays will be processed on the next working day.
We do not deliver to campsites, hotels, post office outlets or P.O. boxes.Customers are offered several delivery methods, with specific rates and delivery times:
- Express delivery by UPS to the delivery address indicated in the order summary. The parcel will be delivered the following day (for all orders placed before 12pm, except on Saturdays, Sundays and public holidays, when the order will be processed on the next working day).
The customer will be notified the day before the parcel is delivered. If the Customer is not present on the day of delivery, the carrier will send the Customer an e-mail/sms indicating the location where the parcel has been deposited.
- Boutique Delivery: Delivery is free and can be made to the Simone Pérèle boutique of the Customer's choice from the drop-down list on the Site when the order is placed. The Customer will receive an SMS from the Vendor notifying the date of availability of the parcel in the boutique. The Customer will be able to collect his/her order within a maximum of 7 days from the date of availability in the boutique.
Delivery Tracking
At any time, the Customer can connect to his/her Customer Account (with your email and password) to track the status of your order step by step.
Calculation of delivery time
The delivery date takes into account preparation time, delivery to the carrier and delivery by the carrier.
Delivery times are calculated in working days, i.e. excluding weekends and public holidays. All orders placed on Friday afternoon, Saturday or Sunday will be processed by Simone Pérèle Benelux on the following Monday.
The above delivery times may be longer than expected at certain times of the year (sales, end of year celebrations, etc.) due to the large volume of packages to be processed. Failure to collect the orderIf the Customer does not collect the parcel from the collection point, the pick-up point indicated in the delivery notice or from the boutique within the specified time, the parcel will automatically be sent back to Simone Pérèle BENELUX's logistics center. New shipping costs will be charged to the Customer.
The customer should contact
Customer Service to find out how to reship the order. The new shipping costs will be borne by the Customer.
Late delivery
Exceeding a delivery deadline may not give rise to any damages or interest or withholding of any kind whatsoever, nor to the cancellation of orders in progress when such exceeding of the deadline results either from the Customer's fault, or from the unforeseeable and insurmountable fault of a third party to the contract, or from a case of Force Majeure as defined in article 19. Except in the aforementioned cases, if the Vendor has not delivered the Products within 30 days of the conclusion of the contract, the Customer may, as a first step, request the Vendor to deliver the Products within a new reasonable delivery period (by registered letter with acknowledgement of receipt or by a durable medium such as e-mail).
If this new delivery period is not respected, the Customer may cancel the contract (also by registered letter with acknowledgement of receipt or by durable medium). Upon receipt of the registered letter by the seller, the contract is considered terminated, unless the seller has proceeded with delivery in the meantime.
ARTICLE 10 - CHECKING THE CONDITION OF THE PRODUCTS ON RECEIPT OF THE ORDER
It is the Customer's responsibility to check the condition of the Products as soon as they are received, and this check is considered to have been carried out once the Customer, or a person authorized by the Customer, has signed the delivery note.
If, upon receipt of the order, the Customer finds that it is not in conformity with the order form, or that it has been damaged in transit, the Customer may either refuse the parcel, or in any case make handwritten reservations on the delivery note, accompanied by his/her signature.
The Customer is invited to contact Customer Services within 15 days of receipt of the damaged parcel or of a product not in conformity with the order, and to follow the returns procedure set out in article 14.2.
ARTICLE 11 - PRODUCT GUARANTEES
The Vendor is liable for hidden defects in the item sold under the conditions set out in articles 1641 et seq. of the French Civil Code and for defects in conformity of the Product with the contract under the conditions set out in article 1649bis et seq. of the French Civil Code.
ARTICLE 12 - 14-DAY RIGHT OF WITHDRAWAL

14 days run from receipt of the goods by the Customer or a third party designated by him when the order was placed. In the case of an order for several goods delivered separately, the period runs from receipt of the last good or batch.
Terms of withdrawalIt
It is up to the Customer to inform Simone Pérèle BENELUX of his decision to withdraw by sending via the contact form, before the expiry of the fourteen day period referred to in Article 12. 1, the retraction form below and return it duly completed or send a written statement clearly expressing his/her wish to retract to the aforementioned address.

Link to downloadable withdrawal formIf the withdrawal letter is sent by post, it is advisable to reproduce the content of the withdrawal form above and to send the letter by registered mail with acknowledgement of receipt, as the burden of proof of withdrawal lies with the customer.
Having given notice of withdrawal, in accordance with Article VI.49 of the French Code of Economic Law, the Customer must return the Products concerned within a maximum of 14 days of such notice, accompanied by the duly completed withdrawal form. In accordance with article VI.51, §2 of the French Code of Economic Law, the Customer is responsible for any depreciation of the Products resulting from handling of the Products other than that necessary to establish the nature, characteristics and proper functioning of the Products.
The reimbursement of Products related to the legal right of withdrawal will be made after receipt of the Products at the Seller's Socoloir logistics center, in accordance with the terms and conditions set out in article 13.2 below.
ARTICLE 13 - PRODUCT RETURN POLICY
Contractual right of return
Without prejudice to the provisions on the legal right of retraction set out in article 12, Simone Pérèle BENELUX offers the Customer a total period of fourteen (14) calendar days from the date of receipt of the Products to return all or part of his/her order with which he/she is not satisfied, in order to obtain a refund.
All Products returned
On the basis of the legal right of retraction or the contractual right of return must be returned to the Socoloir Logistics Centre, whose address is given below, or in the store, in their original packaging and label, in perfect condition for resale, complete, new, unworn, unwashed, unstained and undamaged. Any product returned incomplete, damaged, soiled or washed will not be reimbursed or exchanged.
In the case of a return of all the Products in the order, the Customer must return all the free items or gifts sent in the parcel, failing which the order will not be reimbursed.
The Customer must return the Products with the prepaid return label and the invoice (downloadable from the customer account). This return label will be sent to the Customer who will have respected the withdrawal deadlines mentioned in articles 12.1 and 13.1 above.Simone Pérèle BENELUX will cover the return shipping costs by means of a return label which will be sent to the Customer by e-mail.
This label must be affixed to the return package and returned, at the Customer's discretion, as follows:

- Or directly to your post office or eligible collection point using the Colissimo service. If the Products are not received at the warehouse, the Vendor will not be able to process the return or refund the return.
RefundOnce the Products have been returned and checked by the Vendor, the Customer will be refunded within fourteen (14) calendar days from the date of receipt of the Products by the Vendor at the SOCOLOIR warehouse (France).The refund will be made using the same method of payment as for the initial order, by transfer to the bank account with which the Customer made the payment.
ARTICLE 14 - PROTECTION AND CONFIDENTIALITY OF PERSONAL DATA
La collecte et le traitement des données personnelles du Client s’effectuent conformément à la loi du 30 juillet 2018 relative à la protection des personnes physiques à l'égard des traitements de données à caractère personnel et au Règlement général sur la protection des données n°2016/679 du 27 avril 2016 (ci-après le Règlement). Le responsable du traitement est la société Simone Pérèle SAS.
Les données personnelles concernant le Client sont collectées et traitées par Simone Pérèle SAS :
- aux fins de traiter les commandes passées sur le Site, le service de livraison, les factures et assurer le suivi de la relation Client c’est-à-dire les réclamations et le service après- vente.
Ce traitement de données personnelles est fondé sur l’exécution du contrat de vente liant le Vendeur et le Client.
- Aux fins de l’informer des actualités, dernières nouveautés et offres spéciales par l’envoi de newsletters par email ou par sms ;
- Aux fins de lui proposer de participer à des Jeux-Concours ou de participer à des enquêtes de satisfaction
Ces traitements de données personnelles sont exclusivement fondés sur le consentement du Client ou du Prospect qui peut être retiré à tout moment.
Le Client est informé que ses données sont également susceptibles de faire l’objet d’un traitement ultérieur à des fins de statistique.
Toutes les informations obligatoires nécessaires pour passer une commande, envoyer les newsletters ou répondre à une demande sous l’onglet « nous contacter » seront marquées d’un asterix sur le Site. En cas de refus du Client de communiquer ces données, Simone Pérèle SAS ne sera pas en mesure de traiter les finalités visées.
L’ensemble des données du Client est conservé sous un format permettant son identification pendant toute la durée de la relation commerciale. Au-delà, les données sont archivées pendant la période de prescription de droit commun à des fins probatoires uniquement.
Les données collectées sont destinées à Simone Pérèle SAS et le cas échéant à ses prestataires et sociétés du groupe Simone Pérèle, en particulier Simone Pérèle Benelux, en charge de la gestion des commandes et de la relation client.
Les informations à caractère personnel sont réservées exclusivement à un usage interne et ne seront ni cédées, ni vendues à des tiers sans acceptation expresse du client.
Le Client dispose, conformément à la loi du 30 juillet 2018 relative à la protection des personnes physiques à l'égard des traitements de données à caractère personnel ainsi qu’au Règlement général sur la protection des données n°2016/679 du 27 avril 2016 (le Règlement), d'un droit d'accès permanent, de rectification et – en cas de motif légitime – d'opposition s'agissant des informations le concernant, ainsi qu’un droit à la limitation et à la portabilité de ses données dans les conditions prévues au Règlement.
Le Client a également le droit de déposer une réclamation auprès de l’Autorité de Protection des Données.

ARTICLE 15 - COOKIES
Simone Pérèle Benelux utilise des « cookies » pour optimiser l’utilisation du Site.
A ce titre, l’utilisateur est informé que lors de ses visites sur le Site, un cookie peut, sous réserve de son accord, s’installer sur son logiciel de navigation. Un cookie est un traceur déposé sur le terminal de l’utilisateur qui sert à enregistrer des informations relatives à la navigation de celui-ci sur le Site.Il s’agit principalement de cookies de session permettant l’authentification et la connexion de l’internaute au Site, ainsi que la mémorisation des éléments de navigation pendant la durée de la session.

ARTICLE 17 - FORCE MAJEURE
Simone Pérèle Benelux will not be responsible for the delay in the execution or the total or partial non- execution of its obligations if this event is due to a case of force majeure. In particular, force majeure or fortuitous cases are expressly considered, in addition to those usually retained by the jurisprudence of the Belgian courts and tribunals: total or partial strike of means of transport or supplies, postal services, fires, storms, termination of telecommunications networks or difficulties specific to telecommunications networks external to customers.
Simone Pérèle Benelux will notify the Customer of an event constituting force majeure within five (5) days after its occurrence.The Parties will approach to examine the impact of the event and agree on the conditions for processing the order during the period of force majeure.
If the case of force majeure has a duration greater than one month (1) month, the order will be cancelled by Simone Pérèle Benelux.
ARTICLE 18 - NON PARTIAL VALIDATION
If one of the provisions of these general conditions is held to be invalid or declared as such pursuant to a law, a regulation or following a final decision of a competent court, the other stipulations will retain all their force and scope.
ARTICLE 19 - NO WAIVER
The fact that Simone Pérèle Benelux does not rely on a breach by the other Party of any of the obligations referred to in these Terms and Conditions cannot be interpreted for the future as a waiver of the obligation in question.
ARTICLE 20 - APPLICABLE LAW AND DISPUTE SETTLEMENT
These T&Cs are subject to Belgian law. In the event of a dispute or claim, the Customer will first contact the Seller to obtain an amicable solution and in the event of failure, may use the Consumer Mediation Service, which can be contacted via the following link: http://www.mediationconsommateur.be/fr.Inthe case of a cross-border dispute, the Customer may also use the "Online Dispute Resolution" platform of the European Union via the link: http://ec.europa.eu/odr . the Customer may initiate proceedings before the court of the place of residence.
